ABSTRACT

Environmental protection is a global concern, yet Bangladesh, as one of the most climate-vulnerable nations, faces persistent challenges in enforcing its environmental laws. This study critically explores the gap between environmental law and implementation in Bangladesh, more particularly the institutional and judicial constraints. Despite the existence of a comprehensive legal framework — comprising laws such as the Environment Conservation Act, the Environment Court Act, the Forest Act, and the Wildlife (Conservation and Security) Act — effective enforcement is hindered by several factors. These include inadequate institutional capacity, ambiguities in the legal text, and the limited jurisdiction of the Environment Courts. Such shortcomings impede the implementation of environmental regulations and diminish the overall effectiveness of conservation efforts within the country. A mixed-methods survey of the public, law students, and legal practitioners with doctrinal legal research reveals that writ petitions before the High Court are more frequently used than the Environment Courts, which remains underutilized due to jurisdictional and procedural limits, ineffective enforcement, public inaccessibility of legal remedies, and lack of government accountability constrain progress. The study recommends constitutional recognition of environmental rights, enhanced mandates for Environmental Courts, revised legislation with stronger penalties, and the integration of environmental studies into the legal curriculum, institutional openness, centralized environmental information systems, and mass public awareness, concluding that comprehensive reforms are essential for achieving effective environmental governance in Bangladesh.
